1. Introduction

D.G Consult School-Based Assessment (SBA) System, operated by D.G Consult, located in Kade, Eastern Region, Ghana. These Terms of Service (“Terms”) govern your access to and use of our online SBA platform and related services.

By signing up, logging in, or using this platform, you agree to comply with these Terms. Please read them carefully before proceeding.

2. Purpose of the Service

The SBA System is designed to help schools in Ghana manage continuous assessment and reporting digitally in line with the Ghana Education Service (GES) standards.

• Allow teachers to record and manage student assessments.
• Enable school heads to generate reports and monitor performance.
• Provide accurate data for educational planning and improvement.

3. User Eligibility

To register or use this platform, you must be:

• An authorized staff member, administrator, or teacher of a registered school.
• At least 18 years old or have authorization from a school administrator.
• Using the platform for legitimate educational purposes only.

4. Account Registration and Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and all activities that occur under your account.

• Provide accurate and truthful information during registration.
• Do not share login credentials with others.
• Notify the administrator immediately of any unauthorized use or security breach.
• Use your account only for approved school-related purposes.

5. Acceptable Use

Users agree to use the SBA System responsibly and in accordance with Ghanaian law. You must not:

• Upload false, misleading, or harmful information.
• Access or attempt to access other users’ data without authorization.
• Distribute or export student data outside authorized channels.
• Use the system for commercial, illegal, or non-educational activities.

6. Intellectual Property

The SBA System, including its logo, design, database, and software, is the property of D.G Consult. All rights are reserved.

Users are granted a limited, non-transferable license to use the system for educational purposes. You may not copy, modify, distribute, or resell any part of the system without written permission.

7. Data and Privacy Protection

The collection and use of personal information are governed by our Privacy Policy. By using the system, you consent to the collection and processing of data as outlined in that policy.

8. System Availability

We aim to ensure uninterrupted access to the SBA System; however, maintenance, updates, or unforeseen events may cause temporary downtime. We are not liable for any data loss or inconvenience caused by system unavailability.

9. Termination of Access

We reserve the right to suspend or terminate access to any account that:

• Violates these Terms or data protection regulations.
• Attempts to misuse or damage the system.
• Engages in unauthorized or harmful activities.

Upon termination, all data linked to that account may be archived or deleted per our retention policy.

10. Limitation of Liability

D.G Consult shall not be held responsible for:

• Data entered inaccurately by users.
• Unauthorized access caused by user negligence.
• Temporary loss of access due to network or technical issues.
• Any indirect or incidental damages arising from system use.

11. Modification of Terms

These Terms may be revised from time to time to reflect system improvements or changes in law. Updated versions will be posted on the SBA platform and communicated to all registered schools. Continued use of the platform after updates means you accept the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Republic of Ghana, including the Data Protection Act, 2012 (Act 843) and applicable education regulations. Any disputes shall be resolved within the jurisdiction of Ghanaian courts.
